Floodplain Permit
Building in Floodplains
Structures located in the floodplain or flood-way are subject to additional building regulations designed to protect not only the structure but also the floodplain. If you are contemplating a modification to your existing home or building, contact the Village before starting your design so that you understand the regulations before you get too far along in the process. Please remember that any modification to a structure in the floodplain will require a permit.
Substantial Improvement Rule
You may be able to construct an addition to a structure in the floodplain. In general, the cost of the addition must be less than 50% of the value of the structure itself. This regulation is known as the Substantial Improvement Rule. It is designed to limit the exposure of damage to structures in the floodplain. If the cost of the proposed addition would exceed the fifty-percent threshold, then the entire structure must be brought into compliance with floodplain regulations.
The NFIP requires that if the cost of improvements to a building or the cost to repair damages (from any cause) to a building exceeds 50% of the market value of the building (excluding land value), the entire building must be brought up to current floodplain management standards. Building improvement projects include exterior and interior remodeling, rehabilitation, additions, and repair and reconstruction projects.
Additionally, the cost of currently planned improvements will be added to the cost of previously made improvements and compared to the market value at the time of the first improvement to determine if the improvements exceed 50% of the structure's value. Structure Additions
Additions to structures in the floodplain may be located above the existing footprint or may expand the footprint of the structure. If the footprint is expanded, the additional area must comply with the floodplain requirements, which typically requires that the addition be elevated. You may not expand the footprint of structures in the floodway.
Permitting
All development within the 100-year floodplain (not just construction of buildings, but filling, excavation, fences, etc.) is required to obtain a village permit. Applications must be made prior to doing any work in the floodplain area. Please contact the Village Engineering Department to receive all the information you will need in order to properly develop in the floodplain at 847-588-7920. You may report any illegal development activities to the above number as well.
